1. Scope
These terms apply to logistics services supplied or arranged by [to be confirmed] where incorporated into the relevant quotation, booking confirmation, or service agreement.
The applicable contract specifies whether the company acts as a carrier, freight forwarder, logistics coordinator, agent, warehouse operator, or in another capacity.
Different responsibilities and liability rules may apply depending on that role.
2. Quotations
Quotations are based on the information supplied by the customer and the assumptions stated in the quotation.
Unless otherwise specified, quotations may be subject to confirmation of cargo details, route availability, carrier acceptance, capacity, documentation, and applicable charges.
The quotation states its validity period and identifies which charges are included or excluded.
Changes in shipment details or circumstances may require a revised quotation.
3. Customer responsibilities
Customers must provide accurate and complete shipment information and disclose any special handling, safety, regulatory, or documentation requirements.
Customers are responsible for providing the documents and authorizations required from them under the applicable service agreement and law.
Incorrect or incomplete information may cause additional charges, delays, rejection of cargo, or other consequences under the applicable contract.
4. Cargo preparation and packaging
Unless expressly agreed otherwise, customers must ensure that cargo is appropriately packaged, labeled, and prepared for the agreed transport and handling conditions.
Any specific packaging, labeling, palletization, or handling obligations should be confirmed before booking.
5. Prohibited and restricted cargo
Certain goods may be prohibited, restricted, or subject to special requirements, including dangerous goods, controlled substances, weapons, perishable items, batteries, hazardous materials, or goods subject to sanctions or trade restrictions.
Customers must disclose relevant cargo characteristics before booking.
Acceptance is subject to applicable law, carrier rules, permits, and the agreed service scope.
6. Customs and regulatory requirements
International shipments may require customs declarations, licenses, permits, certificates, duties, taxes, inspections, or other formalities.
The quotation or service agreement specifies who is responsible for each relevant task and charge.
Customers must cooperate with lawful requests for information and documentation. No party should assume that customs duties, taxes, or clearance charges are included unless expressly stated.
7. Pricing and additional charges
Charges will be determined in accordance with the accepted quotation and service agreement.
Additional charges may arise from changes in cargo information, storage, waiting time, inspections, handling, re-delivery, customs requirements, or other events identified in the applicable terms.
Any applicable rules for authorization, notification, and payment of additional charges are specified in the contract.
8. Payment
Payment amounts, currency, methods, deposits, credit arrangements, and due dates are governed by the accepted quotation, invoice, or service agreement.
Any late-payment interest, suspension rights, or cargo-retention rights are stated in the contract and comply with applicable law.
9. Transit times and delivery estimates
Transit times and delivery dates are subject to the specific service arrangement.
Unless expressly agreed as a binding commitment, estimates are not guarantees and may be affected by weather, congestion, carrier schedules, inspections, customs, documentation issues, and other events outside the relevant party's reasonable control.
10. Cargo insurance
Cargo insurance is not assumed to be included unless expressly confirmed in writing.
Customers should review their insurance requirements and confirm the nature and extent of any available coverage before shipment.
The contract distinguishes cargo insurance from any liability that may apply to the company or another service provider.
11. Loss, damage, and delay claims
Customers should inspect cargo promptly upon receipt and notify the appropriate party of visible damage, shortages, or other issues as soon as reasonably possible.
Claims must be submitted with relevant supporting documentation and within the deadlines imposed by the applicable contract and law.
Applicable liability rules, limitation periods, exclusions, and compensation limits depend on the transport mode, the parties' contractual roles, governing law, and any mandatory international conventions.
12. Force majeure and disruptions
Events beyond a party's reasonable control may affect the performance of a shipment. The applicable contract specifies how affected parties must notify one another, mitigate disruption, and address resulting costs or termination rights.
This clause does not automatically excuse every failure to perform and remains subject to applicable law.
13. Subcontracting and service partners
Where permitted by the service agreement, some services may be performed by independent carriers, agents, warehouses, or other service providers.
The relevant contract defines the company's responsibility for selecting, coordinating, or contracting with those providers and explains how their terms affect the shipment.
14. Complaints and disputes
Customers should direct complaints to support@nextway.delivery, including the shipment reference, relevant dates, a description of the issue, and available supporting documents.
The parties should follow the complaint and dispute-resolution process established in the applicable service agreement and mandatory law.
15. Governing law and priority
The applicable quotation, transport document, service agreement, mandatory transport conventions, and governing law may affect these terms.
The final contract specifies the order of precedence among documents and the applicable jurisdiction.
